Justification for the Rule Review Adoption of Chapter 79, Weather Modification

The Texas Commission of Licensing and Regulation ( “Commission”) filed a notice of intent to review and consider for re-adoption, revision, or repeal, 16 Texas Administrative Code (“TAC”), Chapter 79, Weather Modification in accordance with the requirements of Texas Government Code, §2001.039.  The Notice of Intent to Review was published in the September 15, 2006, issue of the Texas Register (31 TexReg 8017).

In accordance with the requirements of Texas Government Code, §2001.039, the Department reviewed the administrative rules of 16 TAC Chapter 79, Weather Modification to determine if the rules were obsolete, reflect current legal and policy considerations, and reflect current procedures of the Department.

The Department’s review determined that the reasons for initially adopting the rules continue to exist.  The rules continue to be essential in implementing the provisions of Texas Agriculture Code, Chapters 301 and 302.  Based on the Department’s review, however, the Commission may propose that amendments be made which may be helpful in clarifying statutory and administrative rule requirements.

These identical bills, titled: “Weather Mitigation Research and Development Policy Authorization Act of 2007”, are moving forward at a rapid rate in Committees on Commerce, Science and Transportation. Please note that these bills were not referred to Committees on Agriculture, Natural Resources, the Environmental Protection Agency, or Forestry, and that you were not invited to debate the merits of these bills by your elected representatives.

It is the purpose of this act to develop and implement a comprehensive and coordinated national weather mitigation policy and a national cooperative Federal and State program of weather mitigation and research.” The Board of Directors will be comprised of eleven members and only one member shall be a representative of the Department of Agriculture. There are no members of the public to be appointed to this Board, no EPA representatives, no Natural Resources or Forestry representatives, and there are no provisions for county, state, public, or agricultural oversight of these programs prior to implementation.


The Weather Modification Association (WMA) was organized in 1950 to cultivate a better understanding of weather modification techniques, impacts, and expectations among program sponsors, program operators, and the scientific community, and to promote ethical professional conduct and a free exchange of information.

Weather modification can be both planned, as is the case in cloud seeding (cloud modification), or inadvertent, for example, when pollution affects visibility.

Planned (deliberate) weather modification is also commonly known cloud seeding, cloud modification, and atmospheric water management. 

The WMA fields a wide variety of inquiries, from domestic and foreign governmental agencies, to the student doing a report for the classroom.

Bacteriophages: the Most Ubiquitous Organisms on Earth

Bacteriophages (or phages for short) are viruses that infect bacteria. The name was coined by one of the discoverers of bacteriophages (Felix d’Herelle), by combining the Greek “phago” meaning “to eat” or “to develop at the expense of,” and “bacteria.” Phages are the most ubiquitous organisms on Earth, and they can be found – often in prodigious numbers – in every living ecosystem. Phages are highly specific for bacteria, and they can not infect eukaryotic cells; i.e., those of humans/animals and plants. Moreover, one phage can only infect a subgroup of strains within the same bacterial species, without affecting strains of other bacterial species.
